Because of the lawsuit, eCW agreed to pay $155 million to the U.S. government and sign a corporate integrity agreement with the Office of Inspector General of the Department of Health and Human Services.
According to a Healthcare IT News article, nearly two-thirds of eCW customers said they have downgraded their opinion about the company (one-third are prepping to switch EHR vendors). More tellingly, “about one-fifth describe the settlement using words like ‘unsurprising,’ indicating that their personal concerns about the vendor’s ethics and business practices have now been confirmed,” according to the report.
What can eClinicalWorks users do now?
The settlement requires that eCW assist customers who want to migrate to another EHR vendor. Customers will not have to pay penalties or service charges for breaking their contracts. The Initial Customer Notification indicates that eCW customers have until May 26, 2018, to take the Data Transfer Option.
